Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Dutch Date LLC ("DutchDate", "we", "us"). By creating an account or using the DutchDate app or website (the "Service"), you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use DutchDate. By using the Service you represent that you are 18 or older and legally able to enter this agreement.
2. Your account
You are responsible for your account, keeping your credentials secure, and all activity under your account. Provide accurate information and keep it current.
3. Acceptable use
You agree to follow our Acceptable Use & Safety Policy. Prohibited conduct includes harassment, fraud, solicitation, impersonation, and requesting or sending money to or from other users through or around the Service.
4. The payment principle
The DutchDate payment principle: each person pays for their own food, bookings, tickets, services and other date expenses, directly to the restaurant, venue, ticket provider or other supplier. DutchDate does not offer bill splitting, does not move money between users, and is not a wallet, escrow service, peer-payment service, or money transmitter. Payments to Dutch Date LLC through Stripe are solely for DutchDate digital subscriptions and clearly identified DutchDate products.
5. Subscriptions & billing
Paid subscriptions are billed through Stripe (web) or the Apple App Store / Google Play (in-app). Subscriptions renew automatically until cancelled. See our Pricing & Payment Disclosures and Refund & Cancellation Policy.
6. Content & conduct
You retain rights to content you submit but grant DutchDate a licence to host and display it to operate the Service. You must not post unlawful, infringing, or harmful content.
7. Safety
DutchDate provides tools to report and block members but does not conduct background checks unless expressly stated. Always meet in public and follow our safety guidance.
8. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or the Acceptable Use & Safety Policy.
9. Disclaimers
The Service is provided "as is" without warranties of any kind to the fullest extent permitted by law. We do not guarantee matches, outcomes, or the conduct of other users.
10. Limitation of liability
To the maximum extent permitted by law, Dutch Date LLC's total liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$100. We are not liable for indirect, incidental, or consequential damages.
11. Indemnification
You agree to indemnify Dutch Date LLC against claims arising from your use of the Service or violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.
13. Dispute resolution & class-action waiver
Disputes are resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Florida. You and Dutch Date LLC each waive any right to a jury trial or to participate in a class or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing hello@dutchdate.app. Nothing here prevents either party from bringing an individual claim in small-claims court.
14. Changes
We may update these Terms. Material changes will be notified in-app or by email, and where required we will ask you to review and accept the new version.
